任天堂、EUの決定を不服として欧州司法裁判所に提訴―1億6780万ユーロの罰金
欧州連合(EU)の欧州委員会が、2002年10月に、任天堂と地域ディストリビューターを務める7社に対して、1991年から1998年にかけて、競争を不当に妨害したとして1億6780万ユーロの罰金の支払いを命じた件で任天堂は、この決定を不服として欧州司法裁判所に提訴したとのこと。

「この罰金は不当かつ違法なもので、衝撃的なものです。EUの競争法の中でも単一の案件としては最も金額の大きいものでもあります」と任天堂の弁護士を務めるIan Forrester氏は述べています。

Microsoft's Shane Kim: First to 100 Million Wins


SAN FRANCISCO -- I've interviewed Shane Kim, corporate vice president of Microsoft and head of the company's internal games studios, three times in the past year, and it's always an enjoyable experience.

Kim pretty much knows by this point that I'm going to bring up all of the hot-topic news stories about Xbox that I can cram in to my allotted time -- this time, it was the PlayStation 3's sales in Europe, the continued rumors of a Wiimote clone for 360, and developers' complaints about Xbox Live Arcade -- and he answers them well, defending the company while simultaneously attempting to fill in the blanks with some solid information.

Where he and I disagreed most strongly this time was on the matter of the console wars, and whether it's possible to call the winner at this point. Although Xbox boss Don Mattrick recently pointed out that the first console to 10 million units is generally a good barometer of victory, Kim says you can't really call it until "somebody's well on their way to reaching 100 million units."

"This is only the third year of our existence and only the second year of Sony and Nintendo's existence. Are we just amusing ourselves by trying to declare a winner and loser while the customers are still out there deciding?" he says.

So I heard you guys are getting rocked in Europe right now by PlayStation 3.

Really?

That's what the news says.

That's what the Sony guys say.

Are you disputing those numbers?

Since the price reduction, we've seen our numbers tick up. There's no question that we need… we made that move for a reason, to try to spur demand. And demand has been spurred. Now the challenge for us is to continue that momentum. The Grand Theft Auto launch is also another big thing for us. I haven't seen any official statements from European retailers, but you saw the GameStop stuff.

Yeah, 60-40?

65-35. That's huge. And I can tell you anecdotally that that's very in line with the data that we're getting from retailers in a lot of different territories.

What's it like in Europe, though? Is it still 65-35?

It's like that in a lot of places in Europe, too.

What happens to the Xbox 360 as a platform if it's only second place in America and not anywhere else?

Well, we've always known that we weren't going to win in Japan, right? And I think we can build a very good business, an exciting business with a pretty big installed base with success in places like North America and Europe. Even though you may not think it's big numbers, we're actually strong in Latin America as well. Canada's been a big market for us as well. So there are ways to get the scale. Now, if you don't get 10 million units in Japan, can you get to 100 million units overall? I'd love to get 90 million units and have that problem. That's what we're really trying to focus on. I think it's way too early to declare a winner. Some guys were trying to declare Nintendo the winner of this generation last night.

You don't think Nintendo's...

I think it's way too early.

When can we call it?

When somebody's well on their way to reaching 100 million units.

That's a long time from now.

Well, it is. But this is only the third year of our existence and only the second year of Sony and Nintendo's existence. Are we just amusing ourselves by trying to declare a winner and loser while the customers are still out there deciding?

I don't know, I feel at this point in last generation's console war it was all pretty much worked out in terms of how it was going to shake out in the end.

It's a lot different, though, this time, right? The winner of the last generation was the winner of the previous generation. They were building off that kind of success. The winner of last generation isn't the winner of this generation, they're in third. So now you're talking about a completely different company, a very good company but not a company that has won a generation in quite a long time. Will they get to expand beyond 35, 40 million to 100 million? Will anybody? I mean, that's going to be an interesting thing to see: Will there be a clear-cut winner like there has been in the last two generations?

Or is it going to be more like Super Nintendo/Genesis where it's head-to-head through the whole generation.

If you know, you can still place a bet. I think it's a little early.
